These Terms of Use ("Terms") govern your use of the websites and mobile applications provided by Nexoft Yazılım Limited Şirketi ("Nexoft", "we", "us") — including Pilates, Yoga, Face Yoga, Home Workout, Chair Yoga and Kegel (together, the "Apps"). By downloading or using an App, you agree to these Terms. If you do not agree, please do not use the Apps.
1. Health & safety disclaimer
The Apps provide general fitness and wellness content for informational purposes. They are not medical devices and do not provide medical advice, diagnosis, or treatment. Consult a qualified healthcare professional before starting any exercise program, especially if you are pregnant, recovering from injury or surgery, or have a medical condition. Stop and seek help if you feel pain, dizziness, or discomfort. You use the Apps at your own risk.
2. Eligibility
You must be at least 13 years old (or the minimum age required in your country) to use the Apps. If you are a minor, you may use the Apps only with the consent and supervision of a parent or guardian.
3. Your account
You are responsible for keeping your account credentials secure and for activity that occurs under your account. Provide accurate information and keep it up to date.
4. Subscriptions, trials & billing
- Some features require a paid subscription. Prices and billing periods are shown before purchase.
- Free trials automatically convert to a paid subscription unless cancelled before the trial ends.
- Subscriptions renew automatically until cancelled. Manage or cancel any time in your Apple App Store or Google Play account settings.
- Purchases are processed by Apple or Google; refunds are handled under their respective policies.
5. Licence & acceptable use
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Apps for your own non-commercial use. You agree not to:
- Copy, modify, distribute, sell, or lease any part of the Apps or their content.
- Reverse engineer or attempt to extract source code, except where permitted by law.
- Use the Apps to break the law or infringe others' rights.
- Interfere with or disrupt the Apps, or attempt unauthorised access to our systems.
6. Intellectual property
The Apps, including all content, video, audio, coaching programs, designs, logos, and trademarks, are owned by Nexoft or our licensors and are protected by law. All rights not expressly granted are reserved.
7. User content
If you submit content (such as feedback or reviews), you grant us a non-exclusive, worldwide, royalty-free licence to use it to operate and improve the Apps. You are responsible for the content you submit.
8. Third-party services
The Apps may rely on third-party services (for example app stores, advertising, and analytics providers). Their terms and privacy practices apply to their services. See ourPrivacy Policy for how data is handled.
9. Disclaimers
The Apps are provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. We do not warrant that the Apps will be uninterrupted, error-free, or produce specific results.
10. Limitation of liability
To the fullest extent permitted by law, Nexoft will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of, or inability to use, the Apps. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
11. Termination
You may stop using the Apps at any time. We may suspend or terminate access if you breach these Terms or where necessary to protect the Apps or other users. Some provisions survive termination, including intellectual property, disclaimers, and limitation of liability.
12. Governing law
These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict of law rules. Mandatory consumer protections in your country of residence continue to apply.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above and, where appropriate, through in-app notice. Continued use of the Apps after changes take effect means you accept the updated Terms.
